Privacy Notice - Business Customers, Suppliers and Business Partners 

This notice sets out what personal information we collect, for what purposes and your rights in this respect. 

What does this Privacy Notice cover? 

This Privacy Notice provides information regarding the personal information which is processed by a company or companies within the which is processed by Premium Velocity Auto, LLC (“PVA Group”, “PVA” or “we”) with its parent company Jiffy Lube International, Inc. (“Jiffy Lube”, “JLI” or “we”) and ultimately, Shell plc (“Shell” or “Shell Group”) in relation to (i) individuals who work for, or on behalf of, or who are shareholders of our business customers (‘Business Customers’), (ii) suppliers or vendors (‘Suppliers’), (iii) business partners, including within non Shell-operated joint ventures, as well as investors and shareholders (‘Business Partners’).

For individuals who require access to a PVA site on behalf of a Business Customer, Supplier or Business Partner you will be asked to provide additional information to enable you to be identified for health, safety and security purposes and to manage the relationship between Shell and the relevant Business Customer, Supplier or Business Partner

Bespoke notices and supplementary privacy statements may contain further information about how PVA is processing your personal information. In those instances, such privacy notices will be communicated to you separately. These privacy notices may vary among the countries in which we operate to reflect local practices and applicable law requirements. 

This Privacy Notice explains what personal information is processed about you, why we are processing your personal information and for which purposes, how long we hold your personal information for, how to access and update your personal information, as well as the options you have regarding your personal information and where to go for further information. 

Consent of the parent or guardian is required if personal data of children is gathered and processed. 

Special Notice: Processing children’s personal information

PVA does not knowingly collect, use, process, or disclose the personal information of children under 16 years old without parental consent. 

The categories from which your personal information is collected. 

What categories of personal information do we process about you? 

We process personal information from and in relation to individuals who are, or who work for or on behalf of or who are shareholders in our Business Customers, Suppliers, Business Partners in the following categories: 

• Private contact information (such as name, postal or e-mail address, and phone number) only if necessary; or 

• Business contact and other information (such as job title, department, name of organization and your dealings with PVA on behalf of yourself or the relevant Business Customer, Supplier, Business Partner). 

Screening 

In addition, in order to comply with legal and regulatory obligations, to protect PVA assets and employees/contractors and specifically to ensure that PVA can comply with trade control, anti-money laundering and/or bribery and corruption laws and other regulatory requirements, we carry out screening (pre-contract and on a periodic basis post-contract) on owners, shareholders and directors of our Business Customers, Suppliers and Business Partners. This screening takes place against publicly available or government issued sanctions lists and media sources. 

The screening does not involve profiling or automated decision making in relation to the counter-parties or potential counter-parties. 

Who is responsible for any personal information collected? 

Premium Velocity Auto, LLC whose registered address is 111 E Troy Street, Suite G Tupelo, Mississippi, 38804 will be responsible for processing your personal data, either solely or jointly by Jiffy Lube International Inc. and/or Premium Velocity Auto, LLC and its affiliates within the Shell Group of companies 

The purposes for which your personal information is processed. 

For what purposes do we process your personal information? 

We process personal information covered by this Privacy Notice for the following purposes: 

• Business execution - including providing, researching, developing and improving products or services; concluding and executing agreements with Business Customers, Suppliers and Business Partners; recording and settling services, products and materials to and from a Shell company; managing relationships and marketing such as maintaining and promoting contact with existing and prospective customers, account management, customer service, and development, execution and analysis of market surveys and marketing strategies; 

• Organization and management of the business - including financial management, asset management, mergers, demergers, acquisitions and divestitures, implementation of controls, management reporting, analysis, internal audits and investigations; 

• Health, safety and security - including protection of an individual’s life or health, occupational health and safety, protection of Shell companies and staff, authentication of individual status and access rights; or 

• Legal and/or regulatory compliance - including compliance with legal or regulatory requirements. 

or for a secondary purpose where it is closely related, such as: 

• storing, deleting or anonymizing personal information; 

• fraud prevention, audits, investigations, dispute resolution or insurance purposes, litigation and defence of claims; or 

• statistical, historical or scientific research. 

Communication and marketing 

You may receive offers on behalf of the relevant Business Customer, Supplier or Business Partner. On all occasions you will be given the opportunity to use the unsubscribe functionality through the different digital channels we use to interact with you. 

The lawful bases for processing your personal information. 

Why do we process your personal information? 

The personal information covered by this Privacy Notice is only processed: 

• in order to take steps at the request of an individual prior to entering into a contract; 

• where it is necessary to comply with a legal or regulatory obligation to which the relevant Shell company/companies is subject to; 

• where it is necessary for the purposes of the legitimate interests pursued by the relevant Shell company/companies, except where such interests are overridden by the interests or fundamental rights and freedoms of the individual/s; or 

• (only if legally required) with the explicit consent of the individual. 

In those cases where processing is based on consent, and subject to applicable local law which provides otherwise, you have the right to withdraw your consent at any time. This will not affect the validity of the processing prior to the withdrawal of consent. 

PVA is committed to safeguarding your personal information. 

Security of your personal information 

We have implemented technology and policies with the objective of protecting your privacy from unauthorized access and improper use. In particular, we may use encryption for some of our services, we apply authentication and verification process for access to PVA services and we regularly test, assess and evaluate the effectiveness of our security measures. 

The sharing and disclosing of your personal information. 

Who will we share or disclose your personal information with? 

The personal information covered by this Privacy Notice is exclusively processed for the purposes referred to above and will only be shared or disclosed on a strict need to know basis with the following categories of recipients: 

• Other companies within the Shell group of companies; 

• Authorized third party agents, service providers, external auditors and/or subcontractors of PVA/JLI; 

• A competent public authority, government, regulatory or fiscal agency where it is necessary to comply with a legal or regulatory obligation to which the relevant Shell company/companies is subject to or as permitted by applicable local law; or 

• As necessary or appropriate to enforce our terms and conditions, and to protect our rights, privacy, safety or property, and/or that of our affiliates, you or others. 

 

Interacting with PVA through social media 

If you interact with PVA through social media, your personal information may be visible to Shell and other visitors depending on your privacy settings on the social media platform. You can change your settings or delete any information through the platform. PVA reserves the right to access and aggregate information provided by you through its Social Media Page for statistics and analytics. For more information on how your personal information is processed on those social media platforms, including any targeted advertising that you may receive, please refer to the social media platform's privacy settings and disclosures. Please contact Shell using the details at the end of this Notice if you have specific questions related to your personal information on a Social Media Page. 

Your personal information may be transferred outside of your country, subject to appropriate

safeguards. 

Transfers of your personal information to other countries 

Where your personal information has been transferred to companies within the Shell group and/or to authorized third parties located outside of your country, we take organizational, contractual and legal measures to ensure that your personal information is exclusively processed for the purposes mentioned above and that adequate levels of protection have been implemented in order to safeguard your personal information. These measures include contractual obligations preventing service providers from selling your personal information and Binding Corporate Rules for transfers among the Shell group. What are the consequences of not providing your personal information? 

Personal information gathered by PVA for these processes either directly or indirectly are required in order to: 

• Fulfil legal requirements and/or which is required for entering into a contract with a counter-party and continuing to contract with that counter-party; or 

• Maintain contact with Business Customers, Suppliers and Business Partners. 

Failure to provide us with the information required will negatively affect our ability to communicate with you, or our ability to enter into a contract with a counter-party or continue to contract with a counter-party. 

The retention of your personal information for a defined period of time.

How long do we hold your personal information for? 

With some exceptions which are explained in supplementary privacy statements, any personal information that is required for the purposes of conclusion and execution of agreements with Business Customers, Suppliers and Business Partners or for considering bids or tenders, will be held during the duration of the contractual relationship and up to 15 years after. For agreements which have a term of more than five years and for the purposes set out above, these agreements will be held for 35 years with effect from the commencement of the agreement. 

In all other cases for the purposes set out above, including personal information gathered as part of any unsuccessful bids to PVA or which relates to the screening against publicly available or government issued sanctions lists and media sources, such personal information is held for no longer than 15 years after it was first gathered. 

In all cases, information may be held for (a) a longer period of time where there is a legal or regulatory reason to do so (in which case it will be deleted once no longer required for the legal or regulatory purpose) or (b) a shorter period where the individual objects to the processing of their personal information and there is no longer a legitimate business purpose to retain it. 

Your rights and how to exercise them. 

Your rights in relation to your personal information 

We aim to keep our information as accurate as possible. Any US resident, regardless of state of residency, can request the following information: 

• access to your personal information, including access to specific pience of personal information where local law applies; 

• correction or deletion of the personal information (but only where they are no longer required for a legitimate business purpose); 

• restriction and objection to the processing of your personal information under certain circumstances and where local law applies; 

• to limit the collection, disclosure or use of your personal information, including sensitive personal information, if collected for unrelated purposes where local law applies; 

• opt-out from the collection and use and/or to limit the disclosure or use of your personal information, including sensitive personal information if collected and where local law applies; 

• opt-out from the sale or sharing of your personal information, including for cross-context behavioral advertising or for targeted advertising, if sold or shared and where local law applies; 

• to no longer receive marketing communications on behalf of the relevant Business Customer, Supplier or Business Partner; and/or 

• to receive personal information that you have provided to PVA, in a structured, digital form to be transmitted to another party, if this is technically feasible.

PVA may use cookies, web beacons, and similar technologies that collect and store personal information when you visit a PVA Website, use a JLI App, or other interact with us through a digital platform, including your device information, IP address, and usage activity. We also enable the use of advertising and social media cookies on PVA Websites; these technologies may track your online activity across third-party digital platforms that are not affiliated with PVA. Motorists, PVA App users and visitors to Shell websites

Information for individuals who are or were a PVA customer, member of a PVA/JLI loyalty program, visitor to a PVA/JLI website and/or user of a PVA digital application.

This Privacy Notice sets out what personal information PVA Group collects, for what purposes and your rights in this respect. 

What does this Privacy Notice cover? 

The Shell group of companies, including Premium Velocity Auto, LLC (“PVA Group”, “PVA” or “we”) with its parent company Jiffy Lube International Inc. (“PVA Group”, “PVA” or “we”), is committed to protecting your privacy and personal information.

• This Privacy Notice (the "Notice") explains what personal information is processed about you; why we are processing your personal information and for which purposes; for how long we hold your personal information; how to access and update your personal information; the rights you have regarding your personal information; and where to go for further information. We may collect and process your personal information when you use services or purchase products from, or interacting with, PVA Group, including as:   
  • a customer at any PVA Jiffy Lube^® Service Center
  • a visitor to a PVA website (“Website” or “PVA Website”)
  • a member of a loyalty program operated by PVA and/or Jiffy Lube; or
  • as a participant in a sweepstake, contest, promotion or competition offered by PVA either alone or with a third party/ies (“Promotion”).

Personal information we collect 

Personal information is information that identifies, relates to, or could be linked, directly or indirectly, with you. We collect your personal information, including information about you as a PVA JLI customer, user of PVA JLI Apps and/or visitor to a PVA Website or PVA administered social media page (“PVA Group Social Media Page”).  Below outlines the categories of personal information we may have collected in the preceding 12 months:  

• Identifiers, including your name, contact information, gender, vehicle type and other vehicle information and attributes you provide, date of birth, and phone 

• Financial information provided by you 

• Commercial information, including payment details and purchase history 

• Internet or other similar network activity, including IP address, log information, browser type and preferences, location information, purchase history, online identifiers, and details of your interaction with PVA Group Websites or ads 

• Social media profile information  

• Audio and electronic information including customer service recordings, event photos, and security footage 

• Inferences derived from personal information to create a profile about your individual preferences or characteristics 

• Precise geolocation data obtained through your device location, when you permit such collection 

From time to time, we may collect sensitive personal information, including precise geolocation, as detailed above and defined under applicable data protection laws. You have the right to limit our collection and use of your sensitive personal information.  

In most cases, you are in control of the information you choose to provide to us; however, in some cases, your choice not to provide some information may impact your ability to interact fully with a PVA Group product, service, program, website, or application. 

PVA Group does not knowingly collect, use, process, or disclose the personal information of children under 16 years old without parental consent. 

From what sources do we collect your personal information?  

• Information that you provide to us – You may choose to provide personal information, including your name, contact details, or other personal details, when creating an account or interacting with PVA Group or to receive communications or marketing offers from us. If you choose to create a PVA JLI user account, a personal profile may be created for you to use and navigate across PVA JLI services. 

• Information that we obtain through your purchase or use of PVA Group services and products - We may also collect information about how and where you use or purchase PVA Group services and products, including (i) specific products you buy, (ii) amounts spent, (iii) the time and place of the purchases you make, (iv) the payment method you use (including, without limitation, anonymized or masked credit or debit card numbers or RFID card number), and (v) any participation by you in a PVA Group or an affiliate's loyalty program. Such information may include electronic device information, IP addresses, log information, browser type and preferences, CCTV footage, location information, online identifiers to enable ‘cookies’, and similar technologies.  

• Information gathered through external sources - We may collect information about you from publicly available sources or through third parties including, but not limited to data brokers and advertising partners. This may include information about your interests, behaviors, and purchases.  

• Information gathered through social media pages - When you communicate with us through a PVA Social Media Page (for example, when you comment on, share or react to a post, upload media, send a personal message, or subscribe to a PVA Social Media Page), we may receive personal information from your profile. 

Why do we process your personal information? 

The personal information covered by this Notice are only processed: 

• with your explicit consent if legally required, 

• to provide our Services such as enabling search functionality to identify and direct you to PVA charging stations and monitoring app use including charging and other activity around charging, 

• to provide our Services such as enabling search functionality to identify and direct you to PVA Group retail branded locations and monitoring app use including fueling and other activity around fueling, 

• where it is necessary to conclude a transaction with you (such as payment, e-receipts or loyalty information), 

• where it is necessary for the purposes of the legitimate interests pursued by the relevant PVA Group company/companies, 

• for the legitimate interests of PVA Group and PVA Group branded retail locations (including the third-party wholesalers, licensees, and retailers who own, operate, or supply such locations), such as for marketing and promotional purposes, for providing you with offers tailored to your preferences, for the purposes of detecting and investigating fraud, and/or responding to security threats, or 
• where it is necessary for PVA to comply with a legal obligation. 

Where the processing is based on consent, you have the right to withdraw your consent at any time. This will not affect the validity of the processing prior to the withdrawal of consent. You can opt-out of receiving direct marketing communications at any time by following the instructions set out in each marketing communication or by contacting us. 

How we use your personal information 

We may process your personal information to: 

• provide our products and deliver our services, and otherwise manage our relationship with you, 

• enable your participation in loyalty programs, 

• analyze which products and services may be of interest to you and send you personalized marketing communications or offer you promotions and contests, including digital rewards, 

• enable account management including account verification, 

• support our customer service and development of our products and services, 

• perform and analyze market surveys and marketing strategies or conduct statistical, historical, marketing, or scientific research, 

• detect or prevent fraud, 

• facilitate audits, investigations, dispute resolution or litigation, or insurance claims 

 or other legal or regulatory compliance, or 

• enable a merger or acquisition, or similar corporate transaction.  

Additionally, specific uses of your personal information are as follows:   

• Precise Geolocation. When you permit us to collect your precise geolocation details, we may use this geolocation data to help you find the nearest PVA Group Station, to complete your transactions associated with PVA Group Pay and Save, for fraud detection, and where you have permitted marketing communications, to serve you with relevant ads. 
• Chatbots. Our chat functionalities and AI-powered chat technologies may collect personal information you submit to these chats to provide, improve, or develop the functionality and to better respond to your and other customers’ future interactions. By choosing to use these technologies, you understand and agree that PVA Group and our third-party service providers may use the information you provide in the chat for quality and training purposes, and to respond to your inquires.  
• Email Tracking. We may use online activity information collected, such as when you open emails from us, for marketing and data analytics purposes. This information may also be shared with certain third parties, as described below. 
• Personal Profiles. Depending on the nature of your engagement with PVA Group, we may combine information provided by you, gathered from third party sources and other PVA Group entities to create a personal profile for you. This enables you to interact with different PVA Group products and services more seamlessly and to develop and provide tailored services and products for your specific interests. We may also use and share with certain third parties, as described below, your profile to identify individuals who have similar interests to you. 

Social Media. If you interact with PVA Group through social media, your personal information may be visible to PVA Group and other visitors depending on your privacy settings on the social media platform. You can change your settings or delete any information through the platform. PVA Group reserves the right to access and aggregate information provided by you through its PVA Group Social Media Page for statistics and analytics. For more information on how your personal information is processed on those social media platforms, including any targeted advertising that you may receive, please refer to the social media platform's privacy settings and disclosures. Please contact PVA Group using the details at the end of this Notice if you have specific questions related to your personal information on a PVA Group Social Media Page. 

Disclosure of your personal information 

We may share your personal information with: 

• Other companies within the PVA Group group of companies, including to those outside your state or country of residence, 

• Third parties that own, operate, or supply PVA Group-branded retail locations, including wholesalers, licensees, and retailers and their respective authorized agents, professional advisors, and contractors, 

• Service providers, contractors or sub-contractors, authorized agents, professional advisors, and external auditors, 

• Authorized third party companies that may supply products and/or services to users of PVA Group products, services, and loyalty programs, 

• A competent public authority, government, or regulatory where it is necessary to comply with a legal or regulatory obligation or as permitted by applicable law, 

• Any person to whom PVA Group proposes to transfer any of its rights or duties, 

• As necessary or appropriate to enforce our terms and conditions, and to protect our rights, privacy, safety or property, or that of our affiliates, you, or others, 

• Service providers, contractors, or sub-contractors involved in advertising or marketing to help promote our products and services and to place interest-based ads on non-PVA Group websites and platforms, 

 

We may also disclose de-identified, aggregate, or anonymous information about PVA Group Website visitors, JLI App users, and charging station customers with service providers, contractors, or sub-contractors involved in advertising or marketing. 

Notice of Financial Incentives/Bona Fide Loyalty Program Disclosure   

We may offer customer loyalty programs that provide certain perks, such as rewards and exclusive offers, and programs, such as sweepstakes, contest, or other similar promotional campaigns. When you sign up for one of these programs, you are typically asked to provide your name and contact details. Because the programs involve the collection of personal information and offering of certain benefits, they might be interpreted as a “financial incentive” program under California law or a “bona fide loyalty program” under Colorado law. The value of your personal information to us is related to the value of the free or discounted products or services or other benefits that you obtain or that are provided as part of the program less the expense related to offering those products, services, and benefits to participants. You may withdraw from participating in a program at any time by contacting us using the designated method set forth in the applicable program rules. Security of Your Personal Information 

We have implemented technical, administrative, and physical safeguards designed to protect your personal information and our systems from unauthorized access and improper use.  When we disclose your personal information, we have administrative and contractual measures with the recipient designed to ensure that the personal information is processed only for the stated purposes and that adequate levels of protection are in place to safeguard your personal information. Your Rights and Choices 

Depending on your jurisdiction of residence, you may have the right to: 

• Obtain confirmation that we maintain certain personal information relating to you and verify the content, origin, and accuracy of the personal information we hold about you, 

• Access your personal information, 

• Request the correction of your personal information, 

• Request deletion or portability of your personal information, 

• Opt-out of Selling, Sharing, and Targeted Advertising, 

• Only have your sensitive personal information, as defined in applicable law, processed with your consent, 

• Residents of California may request information concerning the categories of personal information (if any) we disclose to third parties or affiliates for their direct marketing purposes. 

Should you choose to exercise any of your rights as detailed above, we will not discriminate against you by offering you different pricing or products, or by providing you with a different level or quality of products, based solely upon this request. 

Some of these rights, include the right to correct your information, may be available through self-service on your PVA Group account profile or by following the instructions on communications received (e.g., using the "Unsubscribe" button). You may also use an opt-out preference signal to opt-out of the online sale/sharing of your personal information. We honor Global Privacy Control (GPC) in jurisdictions where the GPC signal is recognized as valid request to opt-out.

The request must provide sufficiently detailed information for verification and to locate the personal information subject to the request.  We may not be able to respond to your request if we cannot verify your identity or authority to make the request. If we need to request further information from you to verify your identity, we will only use that personal information for the purposes of identifying you or that you have authorized the request. In some states, you can designate an authorized agent to make a request on your behalf. 

We will comply with your request as soon as reasonably practicable and as required by applicable law. 

If you wish to opt out of targeted advertising, you can follow the instructions above in addition to the instructions under ‘Cookies and similar online tracking technologies’. Your request to opt-out of targeted advertising may be linked to your browser identifier, and as such you may have to opt-out on additional browsers or devices you use to access our websites, apps, and services. Please note that opting out of sales, sharing, and targeted advertising may not prevent all promotions and advertisements from being displayed to you, including those that do not rely on targeted advertising techniques, and may limit your ability to receive certain promotions and advertisements. 

Retaining your Personal Information.
